In Texas, State Representative Terry Meza (D-Irving) has introduced HB196. Her bill would repeal the state’s “castle doctrine.” This doctrine allows a homeowner to use deadly force against an armed intruder who breaks into his home.
“I’m not saying that stealing is okay,” Meza explained. “All I’m saying is that it doesn’t warrant a death penalty. Thieves only carry weapons for self-protection and to provide the householder an incentive to cooperate. They just want to get their loot and get away. When the resident tries to resist is when people get hurt. If only one side is armed fewer people will be killed.”
Meza was quick to reassure that her bill “would not totally prevent homeowners from defending themselves.
Under the new law, the homeowner’s obligation is to flee the home at the first sign of intrusion. If fleeing is not possible he must cooperate with the intruder. But if violence breaks out it is the homeowner’s responsibility to make sure no one gets hurt. The best way to achieve this is to use the minimum non-lethal force possible because intruders will be able to sue for any injuries they receive at the hands of the homeowner.”
“In most instances, the thief needs the money more than the homeowner does,” Meza reasoned. “The homeowner’s insurance will reimburse his losses. On balance, the transfer of property is likely to lead to a more equitable distribution of wealth. If my bill can help make this transfer a peaceful one so much the better.”

A stunning development on the legal front that directly impacts the so-called conspiracy theory that the death of Seth Rich was something more than routine street crime. The FBI now admits it has Seth Rich’s laptop. This information has just been posted on Lawflog.com courtesy of Ty Clevenger.

According to an email posted at Lawflog.com and sent to attorney Ty Clevenger, the attorney for the FBI now admits that the: FBI has completed the initial search identifying approximately 50 cross-reference serials, with attachments totaling over 20,000 pages, in which Seth Rich is mentioned.  FBI has also located leads that indicate additional potential records that require further searching. . . . FBI is also currently working on getting the files from Seth Rich’s personal laptop into a format to be reviewed. As you can imagine, there are thousands of files of many types. The goal right now is to describe, generally, the types of files/personal information contained in this computer.

After more than four years of repeated denials from the FBI that they had searched their files and had no information on Seth Rich, we now know that was a blatant lie. It was David Hardy, a FBI Senior official, who put that denial in writing in September 2017. Hardy was the Section Chief of the Record/Information Dissemination Section (“RIDS”), Information Management Division (“IMD”),1 Federal Bureau of Investigation (“FBI”), in Winchester, Virginia. He stated under oath that the FBI had no records on Seth Rich:

(19) CRS Search and Results. In response to Plaintiff’s request dated September 1, 2017, RIDS conducted an index search of the CRS for responsive main and reference file records employing the UNI application of ACS. The FBI searched the subject’s name, “Seth Conrad Rich,” in order to identify files responsive to Plaintiff’s request and subject to the FOIA. The FBI’s searches included a three-way phonetic breakdown5 of the subject’s name. These searches located no main or reference records responsive to Plaintiff’s FOIA request.(9) By letter executed on November 9, 2017, OIP advised Plaintiff it affirmed the FBI’s determination. OIP further advised Plaintiff that to the extent his request sought access to records that would either confirm or deny an individual’s placement on any government watch list, the FBI properly refused to confirm or deny the existence of any such records because their existence is protected from disclosure pursuant to 5 U.S.C. § 552(b)(7)(E). . .

In his 2018 declaration, Mr. Hardy also testified under oath that the Metropolitan Police Department in D.C. was solely responsible for investigating Mr. Rich’s murder.

Now we learn that not only does the FBI have more than 20,000 pages relevant to the search term, “Seth Rich,” the FBI still has Seth Rich’s laptop computer.

This does not compute. If Seth Rich truly was a victim of a senseless street crime in the middle of the night in Northeast DC, why would the FBI have his laptop. The FBI is not a computer repair shop. The FBI is not a computer storage facility.

The FBI collects and retains evidence of federal crimes. It also has responsibility for counterintelligence matters. I can understand the FBI collecting Seth Rich’s computer as possible evidence after he was murdered. It would have been entirely appropriate to investigate whether or not Rich was in contact with Wikileaks. The FBI only retains evidence on an active, open case.

But the FBI has insisted for more than four years that it was never involved actively in the investigation of Seth Rich’s murder and that it never opened a case. That lie is now exposed.

What is even more troubling is the fact that the FBI still holds Seth Rich’s computer. If their investigation turned up nothing then the the computer would have been returned to the Rich family. The laptop is still with the FBI. It is now clear that the FBI did open a case regarding the murder of Seth Rich and whether he was a source for the DNC dump to Wikileaks. And that case remains open.

Today’s disclosure from the FBI supports the claim of renowned investigative journalist, who testified in a recent deposition:

that one of his sources had received information from an FBI report stating that Seth Rich had leaked emails to Wikileaks, requested payment and made copies of the emails as a precautionary measure.

After four years of stonewalling, the FBI is now starting to come clean and admit to its previous lies. Why now? If the FBI was confident that Joe Biden and friends would take over in January, they could have continued to lie. Today’s revelation means the FBI is now trying to get ahead of revelations to come. The importance of this development extends beyond the case of Seth Rich and his alleged role in the leaking of DNC emails.

Seventeen states are urging the U.S. Supreme Court to take up Texas’s request to challenge the 2020 election results in four battleground states.

The states, led by Missouri Attorney General Eric Schmitt, filed a friend-of-the-court brief on Dec. 9 underscoring that the case filed by Texas is of great public importance and requires the attention of the nation’s top court.

Texas on Dec. 7 filed a motion asking for permission to sue Pennsylvania, Georgia, Michigan, and Wisconsin in an attempt to protect the integrity of the 2020 election.

The Lone Star state alleges that the four key battleground states unconstitutionally changed election laws, treated voters unequally, and triggered significant voting irregularities by relaxing ballot integrity measures.

In the brief, the 17 states argued that the Texas lawsuit warrants review by the high court as it presents important constitutional issues under the Electors Clause. It also raises concerns about election integrity and public confidence in the handling of elections, they added.

The states said they have a strong interest in protecting the separation of powers in how elections are regulated. When election officials made changes to the rules governing elections, these non-legislative actors may have encroached on the power given to state legislatures by the Electors Clause in the U.S. Constitution, they asserted.

Under the U.S. Constitution, the “times, places, and manner of holding elections” may only be prescribed by the state “legislature” and “Congress.”

“Encroachments on the authority of state Legislatures by other state actors violate the separation of powers and threaten individual liberty,” the states wrote (pdf).

Meanwhile, the changes made by the defendant states to mail-in voting rules during the COVID-19 pandemic, the 17 states argued, would have likely enhanced the risk of election fraud since they strip away safeguards protecting against fraudulent behavior.

They added that the relaxation of safeguards for mail-in ballots create “needless vulnerability to actual fraud and undermined public confidence in the election.”

Some of these changes include removing signature verification, extending the deadline to receive mail-in ballots, and failing to implement consistent statewide standards for the handling of mail-in ballots, the Texas lawsuit alleged.

“These changes removed protections that responsible actors had recommended for decades to guard against fraud and abuse in voting by mail,” the states claimed in their brief.

The states supporting the Texas suit, all of which have Republican attorneys general, are Missouri, Alabama, Arkansas, Florida, Indiana, Kansas, Louisiana, Mississippi, Montana, Nebraska, North Dakota, Oklahoma, South Carolina, South Dakota, Tennessee, Utah, and West Virginia.

Texas is hoping to obtain a declaration from the Supreme Court that the four states conducted the 2020 election in violation of the Constitution. It is also asking the court to prohibit the count of the Electoral College votes cast by the four states. For the defendant states that have already appointed electors, it asks the court to direct the state legislatures to appoint new electors in line with the Constitution.

Meanwhile, the state is also seeking a preliminary injunction or a temporary restraining order to block the four states from taking action to certify their election results or to prevent the state’s presidential electors from taking any official action. The presidential electors are scheduled to meet on Dec. 14.

The court has ordered the defendant states to respond to Texas’s motions by 3 p.m. Thursday, Dec. 10.

President Donald Trump’s campaign has also asked the court to allow it to join Texas in the case as a plaintiff. The president on Dec. 9 has described the case as “the big one,” adding that the “Country needs a victory.”

Goya Foods and president CEO Bob Unanue revealed that after Rep. Alexandria Cortez (D-NY) echoed a call for a boycott of Goya products back in July because Unanue supported President Trump, his company named her “Employee of the Month” because sales rose so dramatically.

Unanue was interviewed on The Michael Berry Show, where Berry commented:

When you see the radical plans like the Green New Deal, when you hear politicians like AOC spouting these things off, agriculture is a major employer in this country but it’s also a major consumer of energy, as you noted earlier. It’s an intensive process for labor and energy. And they are talking about things that would drive the cost of energy through the roof in some cases making it prohibitive for marginal players. How much does that concern you and how much do you feel the need to step up and say, “Hey, guys, you want me to lay off these thousands of employees because that’s what would have to happen?”

Unanue replied:

You know, communism works until you run out of other people’s money to spend. We’re not going to be able to do that. It’s interesting that AOC was one of the first people to step in line to boycott Goya; go against her own people, as supposedly a Puerto Rican woman, to go against people of her own Latin culture. She’s naïve. To some extent I can understand AOC; she’s young; she’s naïve; she doesn’t get it. But you’ve got someone like (Bernie) Sanders, who’s older than us, older than me, and he still doesn’t get it.

“We still have to chat with AOC; I love her,” Unanue continued. “She was actually our Employee of the Month; I don’t know if you know about this, but when she boycotted us, our sales actually increased 1,000%. So we gave her an honorary — we never were able to hand it to her but she got Employee of the Month for bringing attention to GOYA and our adobo. Actually our sales of adobo did very well after she said ‘Make your own Adobo.’”

Berry wondered, “Was it P.T. Barnum who said, ‘Say what you want just spell my name right. All publicity is good publicity.”

Unanue replied, “She’s our hero. She helped boost sales tremendously.”

Berry asked, “I don’t know, I’m sure you know your demographics better than anyone, but I would be interested to know how many samplers you achieved after that because I suspect a lot of people went to the grocery store and said for the very first time, ‘Can you tell me where I can find a can of Goya?’ and bought a cart full of ’em that had never bought your products and some of that residual stays?”

Unanue answered, “What happened was we reached so many new people at the same time we maintained our base…”
