There’s No Way the IRS Was Prepared for Rand Paul’s Latest Move Against Them
Rand Paul has a penchant for making trouble for government establishments he feels are in violation of the constitution.
He’s made a career on challenging the establishment and has constantly been a thorn in the government’s side.
And while the IRS isn’t technically a government organization, don’t think Paul’s going to let them off the hook for over-stepping their authority.
In fact, Paul has just filed a lawsuit against the IRS. One of the first of its kinds.
Bloomberg Business writes:
“Republican presidential candidate Rand Paul sued the Treasury Department and Internal Revenue Service over rules on how Americans abroad are taxed and what foreign banks must disclose about U.S. customers.
The Foreign Account Tax Compliance Act is supposed to make it harder to hide assets overseas, yet its regulations are unconstitutional and violate privacy rights of U.S. citizens, Paul said in the complaint. The suit, filed Tuesday in federal court in Dayton, Ohio, also seeks to strike down requirements for Americans to file reports on foreign accounts over $10,000.
The tax act, or Fatca, “imposes enormous economic costs on individuals and financial institutions,” according to the suit by the U.S. senator from Kentucky and six others. It makes millions of Americans living abroad report accounts above $50,000 with their annual tax returns. Fatca also requires foreign banks to report any account held by a U.S. taxpayers.
“On the most fundamental level, Fatca deprives individuals of the right to the privacy of their financial affairs,” according to the complaint. “On a practical level, Fatca is severely impinging on the ability of U.S. citizens to live and work abroad.”
Justice Department representatives didn’t immediately respond to an e-mail after regular business hours seeking comment on the lawsuit.
President Barack Obama signed the law in 2010, and the Treasury Department reached cross-border agreements that are easier for governments and banks to use than the strict rules in the law itself.
Those accords, which didn’t get congressional approval, are unconstitutional because they exceed the president’s authority, Paul claims. He asked a judge to strike down the Canadian, Czech, Israeli and Swiss agreements.
Paul, a frequent critic of the IRS, is blocking Senate ratification of a U.S.-Swiss tax treaty signed in 2009.
The lawsuit also targets the Treasury requirement that U.S. residents abroad disclose accounts through a Report of Foreign Bank and Financial Accounts, or FBAR. Americans who willfully violate the law are subject to penalties of 50 percent of the high balance of the account — a levy that can run into the millions of dollars.
Paul claims the penalties under both the FBAR provision and Fatca violate constitutional protections against excessive fines.
The lead lawyer on the case is James Bopp Jr., a longtime conservative activist whose clients have included the Republican National Committee.
Fatca requires U.S. financial institutions to impose a 30 percent withholding tax on payments made to foreign banks that don’t agree to identify and provide information on U.S. account holders. It allows the U.S. to scoop up data from more than 77,000 institutions and 80 governments about its citizens’ overseas financial activities.
The case is Crawford v. U.S. Department of Treasury, 15-cv-00250, U.S. District Court, Southern District of Ohio (Dayton)”.
Admittedly a lawsuit against the IRS probably won’t do much.
Even when they’re caught with their hands in the proverbial cookie jar all that ever happens is they receive a minor slap in the wrist.
The encouraging thing in all of this is seeing Paul, a Presidential candidate, refusing to let the government continue to grow in scope.
These are the hallmarks of a willing and committed libertarian, and we can be sure if Paul were elected he would use his executive authority to shrink the size and scope of governmental authority.

Over the weekend, “the Donald” backed down on his attacks on McCain, calling “Hanoi John” a “war hero.” However, Donald is not going to be able to close the can of worms he opened. Today, McCain is trying to wrap himself in the POW flag for cover. POWs had never been rock star heroes before, quite the opposite. These are people who surrendered to the enemy, people suspected of collaboration and worse. With Korea, POWs became the shame of America with many “brainwashed” into following communist doctrines.
American POWs from Vietnam were the bloody flag Richard Nixon wrapped himself in, on the advice of Henry Kissinger, part of a ploy to divert attention from his endless personal failings which included his agreement with North Vietnam that let them keep and later execute hundreds of American POWs. 1205 American POWs were kept by North Vietnam according to records recovered at the end of the Cold War. President’s Clinton and Yeltsin instituted a search of Russia’s gulags looking for their remains with no success. In 1993, armed with testimony from a former high ranking Czech security official, I proposed a systematic search of archives in Prague that recorded the fate of 200 missing US POWs from Vietnam but was blocked by Senator John McCain.
33 POWs faced execution for treason after Vietnam until Nixon pardoned all POWs. McCain was on the list of the 33, in fact at the head of it.

Event for Donald Trump in phoenix will draw thousands

Donald J. Trump, the real estate mogul who has tied Republicans in knots in recent weeks with his comments on immigration, will roll into Phoenix on Saturday to address the issue again, just after the head of the Republican Party supposedly asked him to tone down his words on the issue.
The planned speech is already attracting a storm of attention. Even as city leaders have asked (emphasis added by me ) Mr. Trump “to stage his hate-filled circus” elsewhere, ticket requests have been so high the campaign has moved the speech from the swank Arizona Biltmore hotel to the convention center downtown.
“Mr. Trump certainly has a First Amendment right to bluster as much as he wants, and even to pander to our worst instincts in a sad attempt to win votes at the expense of hard-working, honorable, law-abiding Latinos,” Daniel Valenzuela, a Democratic councilman and the city’s vice mayor, said on Thursday. “However, we should draw the line at allowing him to use the Phoenix Convention Center — a public building funded by all of our taxpayers’ dollars.”
Mayor Greg Stanton, also a Democrat, issued a similar statement condemning Mr. Trump and his remarks, but assured that the city would not try to prevent the candidate from speaking.
Mr. Trump’s spokeswoman, Hope Hicks, said on Friday that 4,500 tickets had already been reserved for the speech, 3,500 more than initially expected.
Mr. Trump will appear onstage with Joe Arpaio, the long-serving sheriff of surrounding Maricopa County, whose tactics to track down and deport illegal immigrants have drawn national attention and a federal conviction for racial profiling in 2013.
Mr. Trump has attracted sharp criticism from business and political leaders since asserting in his campaign announcement that those crossing the United States-Mexico border illegally include rapists and criminals. The remarks led several businesses, including Macy’s, Univision and NBC, to cut their ties with the developer.
Republicans will be watching the weekend swing through the desert closely to see if Mr. Trump tempers his language on the issue. This week, Reince Priebus, the chairman of the Republican National Committee, was said to have urged Mr. Trump in a phone call on Wednesday to soften his tone on immigration.
Mr. Trump is expected to start the day on Saturday in Las Vegas, where he will speak at FreedomFest, an annual libertarian-leaning gathering that bills itself as the “world’s largest gathering of free minds.” Ms. Hicks said he will also hold a press conference after the event.

The main stream media has been told to tell lies and they are gladly doing so. They have been told who to push for the next president. The next president has already been “elected”, it is the job of the media to convince the American public to go along with that particular choice.
While illegal immigrants account for about 3.5 percent of the U.S population, they represented 36.7 percent of federal sentences in FY 2014 following criminal convictions, according to U.S. Sentencing Commission data obtained by Breitbart News.
According to FY 2014 USSC data, of 74,911 sentencing cases, citizens accounted for 43,479 (or 58.0 percent), illegal immigrants accounted for 27,505 (or 36.7 percent), legal immigrants made up 3,017 (or 4.0 percent), and the remainder (about 1 percent) were cases in which the offender was either extradited or had an unknown status.
Broken down by some of the primary offenses, illegal immigrants represented 16.8 percent of drug trafficking cases, 20.0 percent of kidnapping/hostage taking, 74.1 percent of drug possession, 12.3 percent of money laundering, and 12.0 percent of murder convictions.
One GOP aide expressed shock at the numbers, emailing Breitbart News, “These statistics blew me away, and they blow a hole through the oft-repeated line that people only want to come to America to work. It’s tragic so few politicians are willing even to acknowledge the true extent of this problem, but until more do, more Americans will keep getting harmed.”
The USSC data only deals with federal offenders sentenced under the Sentencing Reform Act of 1984 (SRA) and does not include other categories like state cases, death penalty cases, or “cases initiated but for which no convictions were obtained, offenders convicted for whom no sentences were yet issued, and offenders sentenced but for whom no sentencing documents were submitted to the Commission.”
The data does include immigration violations, of which illegal immigrants represented by far the greatest number of cases: 91.6 percent, or (20,333 cases), out of a total 22,204 cases.
Eliminating all immigration violations, illegal immigrants would account for 13.2 percent of all the offenders sentenced in FY14 following federal criminal convictions — still greater than the 3.5 percent of the population illegal immigrants are said to make up.

The politicians like to keep the money trail brushed as clean of their footprints as possible, to make it less blatantly obvious that they are exchanging votes for “campaign” cash. Money talks in DC. In our current government it is the only language other than Orwellian double speak which is understood.
John Boehner, Paul Ryan, Mike McCarthy and other House members did quite well for themselves financially in the pursuit of their corporate masters’ dreams of overthrowing the United States government.
Anyone who wonders how millionaires or billionaires are made on a Congressional salary can get some good insight from this information, published by Maplight.org.
In the instance of H.R. 1314, the legislative vehicle for moving Obamatrade, from the period of October 1st of 2012 to September 30th of 2014, the amount of “potentially” influential financial contributions heaped upon the largely unscrupulous members of Congress in both chambers was nothing short of obscene.
Contributions from pro-Obamatrade lobbyist alone were enough to make very wealthy people of those who are supposed to represent the citizens, and the period of time immediately preceding the vote, that between October 1st of last year and June of 2015 is still unknown. Certainly the pot was “sweetened” considerably more as the deadline drew nearer.
Contributions to House members from forces favorable to Obamatrade outnumbered those from those opposed by a factor of 8.6 times, $197,869,145 to $23,065,231. The differences were even more stark in the Senate, with a total of $285,225,162 in financial incentives being meted out from supporting groups and only $27,569,149 from the opposition, over ten times as much. There were 32 House members with over a million dollars in contributions and many who were just below that threshold. In the Senate, only five Senators were below the one million dollar mark, and two of those, Senator Jeff Sessions (R-AL) and Mike Lee (R-UT) voted no, and against betrayal of their country.
The formula in the House seems fairly simple, at least as far as rewarding those in leadership positions. Speaker John Boehner (R-OH) got a cool $5 million and change, Mike McCarthy (R-CA) half that at $2.4 million, and Steve Scalise (R-LA) half again at $1.2 million. For Paul Ryan, the price of American sovereignty was $2.2 million.
Rep Bob Goodlatte (R-VA) was a member of the million dollar club at $1,053,646. Jeb Hensarling (R-TX) collected $1.4 million, Cathy McMorris Rogers received (R-WA) $900,732 and Mike Pompeo (R-KS) $949,708. Pete Sessions, House Rules Committee chairman, was compensated to the tune of $1,057,079, with his fellow Texan, Lamar Smith picking up $608K. Marsha Blackburn (R-TN), who fought against illegal immigration, we thought, during the amnesty battle, received $700,687 and voted for uncontrolled immigration and the usurpation of domestic American rule.
Financial gain doesn’t appear to be the only reason behind surprising anti-American votes in favor of the three secret bills, a dictatorship and foreign control of our nation. Disappointing betrayals by supposed champion of conservatism, Steve King (R-IA), who received only $382K, Jason Chaffetz (R-UT) $358K, and Trey Gowdy at $305K still don’t make sense.
In the Senate the picture is even uglier, and much more blatant. Mitch McConnell (R-KY) “acquired” $9.2 million, John Cornyn (R-TX) $5.3 million and Orrin Hatch $4.2, the third member of the Senate trio of traitors forcing this upon us.
Marco Rubio pocketed $3.9 million for voting to tie us to a bill he never read, with his fellow presidential candidate Lindsey Graham “earning” $3.4 million. Candidate Rand Paul (R-KY) voted against the package both times it came up in the Senate. Ted Cruz (R-TX) first voted in favor of it but was eventually forced to recognize the will of the people in the interest of the survival of his campaign and cast a meaningless vote once the debate and outcome was determined.
It is clear that money talks, and the people can take a hike. Once the numbers come in for the current year, it will be interesting to note just how much influence was purchased in the last days and weeks leading up to this betrayal. While nobody in the Senate is stupid enough to admit that their vote was purchased or influenced by being handed the equivalent of a mansion or a lifetime of earnings for most Americans, neither are we stupid enough to believe that a pattern of corruption doesn’t exist.
We were sold and our “representatives” were purchased. It’s that simple.
